Sheffield City Council
acts as Trustee for Graves Park, and so any decision to allow St
Lukes to redevelop at Graves Park will be made by the Cabinet but
could, and probably will, be "called in" to Full Council.
It may well be that that
is where the decision is made and that the Green Party Councillor's
vote will count. Councillors have been advised by the city solicitor
that this is a quasi-legal responsibility so that Councillors must
keep an open mind and not vote on purely party political lines.
The Charity Commission have written an open letter
to the Friends of Graves Park which makes it quite clear that the
terms of the trust would not allow the land to be used for anything
other than parkland. St Lukes say they have received legal advice
which contradicts this, but they have not published it. We
have asked the Chief Exec of St Lukes to let us see their legal
advice but so far they have not done responded; for example, they
have not put it in their press releases, neither did they
didn't share it at the meeting with the Friends of Graves Park chaired
by Richard Caborn.
If St Lukes are right and it IS legally possible
to do some kind of land swap, only then would the Council be able
to dispose of the land. In which case the other pros and cons would
come into play.
